Terms of Service

Acceptance of Terms

By creating an account or using VideoPudding (the "service"), you agree to these Terms of Service. If you do not agree, please do not use the service.

The Service

VideoPudding lets you create short videos with artificial intelligence, from text prompts, from photos you upload, and with preset effects. Videos are produced by third-party AI models. Results vary and may sometimes be inaccurate, unexpected or fail entirely. We may add, change or remove models, effects and features at any time.

Accounts

You must be at least 16 years old to use the service. You are responsible for keeping your login details safe and for everything that happens under your account. Tell us right away if you notice unauthorized use.

Your Uploads

You keep ownership of the photos, videos and text you upload. By uploading them you confirm that:

• you own them or have permission to use them for this purpose;
• every identifiable person in them has agreed to be used this way, and anyone shown in a romantic or intimate effect (such as AI Kiss) is an adult;
• your uploads do not break any law or anyone else's rights.

You give us a limited license to store and process your uploads only to provide the service to you, including sending them to our AI model providers to create your video.

Acceptable Use

You must not use the service to create or share content that:

• is sexual or nude, or sexualizes anyone, and never anything involving a minor;
• shows a real person without their consent, or is meant to deceive people into believing a real person said or did something;
• harasses, threatens, bullies or defames anyone;
• promotes violence, hate, self-harm, terrorism or illegal activity;
• makes a real person appear to say something they did not say, or imitates a real person's voice, without their consent;
• infringes copyright, trademark, privacy or publicity rights.

You also must not try to get around our limits, resell access without permission, or attack, overload or reverse engineer the service. We and our model providers may block prompts or uploads that appear to break these rules. We may remove content and suspend or close accounts that break them.

Generated Videos

As between you and us, you own the videos you create, to the extent the law allows. Videos made with a paid plan or purchased credits may be used commercially. Because AI output is not unique, other users may receive similar results. You are responsible for how you use and share your videos.

Credits, Plans and Payments

• Each generation costs the number of credits shown before you start it. If a generation fails, its credits are returned automatically.
• Subscription plans are billed in advance for each billing period and renew automatically until you cancel. Subscription credits are granted each period and expire at the end of that period.
• Credit packs are one-time purchases. Their credits expire 12 months after purchase.
• Credits have no cash value and cannot be transferred.
• You can cancel a subscription at any time from your billing page. Your plan stays active until the end of the paid period.
• Payments are handled by our payment providers. Except where the law requires otherwise, payments for used credits are not refundable. If you believe you were charged in error, contact us within 14 days.

Availability

We work to keep the service running, but it is provided "as is" and may be interrupted, for example when an AI model provider is unavailable.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or profits, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Termination

You can stop using the service and delete your videos at any time. We may suspend or end your access if you break these terms or if we have to by law.

Changes

We may update these terms. When we make a material change we will update the date above and, where appropriate, notify you in the service. Continuing to use the service after a change means you accept the new terms.
